§ 6-30. Employee licensing.

  • The following provisions apply to all establishments holding a license under this chapter:

    (1)

    This section has been enacted for the purposes, among others, of promoting the health and general welfare of the community; to establish reasonable and ascertainable standards for the regulation and identification of employees of licensees under this chapter that are likely to serve alcohol or interact in a substantial way with those patrons purchasing or consuming alcohol from these licensees; and to ensure that such employees, having access to and control of alcoholic beverages and their distribution, are identifiable in the event of any reports of incidents occurring at establishments licensed to sell alcoholic beverages.

    (2)

    Any person obtaining his or her initial serving license permit within the city shall be required to watch a mandatory training video on the responsible service of alcohol at Helen City Hall. The training video will be available for viewing twice weekly at city hall and only at those times designated by the city administrative staff. The serving license permit will not be issued without completing the training.

    (3)

    This section does not apply to employees whose duties are limited solely to those of a bus person, cook or dishwasher; or to a restaurant host or hostess whose job consists solely of greeting and seating customers, and who does not serve, sell or take orders for alcoholic beverages.

    (4)

    No licensee under this chapter shall allow any employee required to hold a serving license on the licensed premises unless the licensee has on file, on the premises, the current, valid license permit of such employee in accordance with this chapter. The employee's photo identification serving license must clearly be displayed and visible on their person at all times when the employee is working.

    (5)

    If any permit holder leaves the employ of a licensed establishment, the licensee and permit holder shall immediately notify the city of this change in employment, in writing, and upon obtaining further employment in the city for a position as stated above, the permit holder shall notify the city of his or her new place of employment, in writing, within 72 hours.

    (6)

    All serving license permits issued hereunder remain the property of the city, and shall be produced for inspection upon the demand of the police department.

    (7)

    Violations of this section may be cited and punished in accordance with section 1-7 of this Code, and may also serve as grounds for suspension and/or revocation of licensees in accordance with section 6-27 of this Code.

    (8)

    The fee for this permit is to be set by the city manager.

    (9)

    This Municipal Code section specifically incorporates the provisions of Official Code of Georgia § 3-3-24. Persons under 18 years of age not to be allowed or required to serve, sell, or take orders for alcoholic beverages; exceptions

    a.

    No person shall allow or require a person in his employment under 18 years of age to dispense, serve, sell, or take orders for any alcoholic beverages.

    b.

    This code section (O.C.G.A. § 3-3-24) shall not prohibit persons under 18 years of age who are employed in supermarkets, convenience stores, breweries, or drugstores from selling or handling alcoholic beverages which are sold for consumption off the premises.
