§ 6-73. Brewpubs.

  • (a)

    Brewpub means any eating establishment in which beer or malt beverages are manufactured or brewed, subject to the barrel production limitation and such other limitation as are prescribed in the Official Code of Georgia.

    (b)

    No individual or entity shall be permitted to own or operate a brewpub without also obtaining a proper license from the Department of Revenue in the manner proscribed, and each brewpub license holder shall comply with all other applicable state and local license requirements;

    (c)

    A brewpub license will authorize the holder of such license to manufacture malt beverages in this state shall include the right to sell up to 3,000 barrels of malt beverages per year produced at the brewer's licensed premises to individuals who are on such premises for:

    (1)

    Consumption on the premises.

    (2)

    Consumption off the premises, provided that such sales for consumption off the premises shall not exceed a maximum of 288 ounces of malt beverages per consumer per day.

    (3)

    A license fee of $600.00 shall apply to brewpubs for the sale of malt beverages produced at their licensed premises. Additional licensing fees shall apply should the brewpub intend to sell any alcoholic beverages not produced on premises.

    (d)

    A Brewpub may sell malt beverages brewed or manufactured on its premises on all days and at all times that sales of malt beverages by retailers are lawful within the city, including, but not limited to, Sundays.

    (e)

    Any brewer engaging in sales of malt beverages pursuant to this Code section shall remit all state and local sales, use, and excise taxes to the proper tax collecting authority, and comply with all other regulations of the Georgia Department of Revenue and the Official Code of Georgia.

    (f)

    A brewpub license holder may also obtain a package license for selling wine or malt beverage growlers for malt beverages not produced on its premises, in accordance with section 6-71 of this Code for consumption off the premises, provided the brewpubs remits payment for the package license required.

    (g)

    A Brewpubs license holder may obtain an on premises consumption license and offer for on premises consumption any other alcoholic beverages, including wine, distilled spirits, and malt beverages, provided that such alcoholic beverages are purchased from a licensed wholesaler for consumption on the premises; and that the brewpubs obtains and remits payment to the city for the on premises consumption required.
